We use third-party age verification services and reserve the right to cancel any order where age verification cannot be completed. We do not knowingly allow the purchase of alcohol by persons under the legal drinking age.

5. Shipping, Delivery, and Alcohol Regulations
Everie ships wine directly to consumers only where permitted by applicable state law. Shipping availability is confirmed at checkout based on your delivery address. We currently ship within the United States only.
By placing an order, you acknowledge and agree that:
Alcohol shipments are subject to state-by-state legal restrictions and may not be available in all states;
All deliveries require an adult signature from a person who is 21 or older with valid government-issued photo ID;
If no qualifying adult is available to sign, the carrier will not leave the package and may attempt redelivery or return the shipment;
You are responsible for ensuring a qualifying adult is available to receive your order;
Everie is not responsible for refused or undeliverable shipments due to the unavailability of a qualifying adult.

6. Subscriptions
Certain products may be offered on a recurring subscription basis through a third-party subscription management provider. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis according to your selected delivery schedule until you cancel.
Subscriptions automatically renew unless canceled before the next billing cycle. You may modify or cancel your subscription at any time through your account portal or by contacting customer support at hello@everiewine.com. Cancellations requested after a billing cycle has processed will take effect on the following renewal date.
We reserve the right to modify subscription pricing with advance notice. Continued enrollment following notice of a price change constitutes your acceptance of the new pricing.
7. Returns, Refunds, and Damaged Orders
Due to state and federal alcohol regulations, we are unable to accept returns of wine once it has shipped, whether opened or unopened, except in the following circumstances:
Your order arrived damaged or in an unusable condition;
You received the wrong item.
If your order arrives damaged or incorrect, please contact us within 7 days of delivery at hello@everiewine.com. Include your order number and photos of the issue. Upon verification, we will send a replacement or issue a refund at our discretion.

8. Intellectual Property
All content on this Site, including but not limited to text, graphics, images, video, logos, product names, product descriptions, and the overall design and layout of the Site, is the property of Everie or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, copy, modify, distribute, transmit, display, publish, or create derivative works from any content on this Site without our prior written permission. Unauthorized use of our intellectual property may give rise to a claim for damages or constitute a criminal offense.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO EVERIE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or products (collectively, "Disputes") shall be resolved through binding individual arbitration administered by JAMS under its applicable rules, except that either party may bring individual claims in small claims court if the claims qualify.
YOU AND EVERIE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR CONSOLIDATED PROCEEDING OF ANY KIND. You may only resolve Disputes with us on an individual basis.
The arbitration will take place in Benton County, Washington, unless otherwise agreed. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
13. Governing Law
These Terms and any Disputes arising from or related to them shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Benton County, Washington.
14. Alcohol Regulatory Compliance
Everie holds the licenses and permits required to sell and ship wine directly to consumers in the states where we operate. By purchasing from us, you represent that the receipt and possession of wine shipped to you is lawful under the laws of your state and locality.
You agree not to resell, redistribute, or transport wine purchased from Everie across state lines in violation of applicable law. Everie reserves the right to limit quantities, restrict shipping destinations, or cancel orders to ensure compliance with applicable alcohol beverage control laws.

This Shipping Policy outlines how orders placed on everiewine.com are processed and delivered. Because Everie sells wine, all shipments are subject to state and federal alcohol beverage laws. We currently ship within the United States only. Shipping availability is confirmed at checkout based on your delivery address.
Order Processing
Orders are typically processed within 1 to 3 business days after purchase. Processing times may be extended during product launches, promotional periods, and major holidays.
Orders may be canceled within a short window after purchase. Once an order has been processed for shipment, we are unable to cancel it. To request a cancellation, contact hello@everiewine.com as soon as possible.

Shipping Options

Delivery Requirements
Because Everie ships wine, all deliveries require:

Carriers will not leave wine unattended. If no qualifying adult is available to sign at the time of delivery, the carrier will attempt redelivery or hold the package at a local facility. Everie is not responsible for delays or non-delivery resulting from the unavailability of a qualifying adult.
Alcohol Shipping Restrictions
Wine shipments are subject to state alcohol beverage control laws. We are unable to ship to all states. If we are unable to ship to your address due to legal restrictions, you will be notified at checkout and no charge will be applied.
By placing an order, you confirm that receiving wine shipped directly from a winery or retailer is lawful in your state and locality.
Lost or Stolen Packages
Once an order has shipped, responsibility for delivery rests with the carrier. If your package is lost or stolen, we recommend contacting the carrier directly using the tracking number provided in your shipping confirmation email.

Damaged or Incorrect Orders
